1. General & Sales Channels
- Scope: These Terms apply to all orders placed directly via our website, Shopify storefront, or any connected sales channels.
- Jurisdiction: Neofidgets trades exclusively within the United Kingdom. These Terms are governed by and construed in accordance with the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
2. Product Safety, Age Suitability & Intended Use
- Choking Hazards & Small Parts: Many of our fidget toys contain small components or magnetic elements. They are not suitable for children under 3 years of age, or any individuals who have a tendency to place inedible objects in their mouths.
- Adult Supervision: All items purchased from Neofidgets must be used under appropriate adult supervision where applicable.
- Wear and Tear: Fidget toys are tactile products designed to be squeezed, manipulated, twisted, or pressed. Over time, physical wear, degradation, or damage will occur based on normal usage.

3. Purchaser Responsibility & Limitation of Liability
Please read this section carefully.
- Assumption of Risk: The purchaser assumes full responsibility for ensuring that any product bought from Neofidgets is suitable for the intended user and used strictly in accordance with safety warnings, age guidance, and normal intended operation.
- Misuse & Negligence: Neofidgets shall not be held liable or responsible for any injury, harm, loss, damage, or medical complication resulting from: misuse, abuse, or over-straining of the products; ingestion, inhalation, or swallowing of small parts, components, or broken pieces; failure to adequately supervise children or vulnerable users; or modifications or alterations made to the product after purchase.
- Product Wear & Breakage: While we aim to supply high-quality goods, toys that are repeatedly stressed can break. Inspect products regularly. If an item breaks or shows signs of significant wear, discontinue use immediately and dispose of it safely. Neofidgets accepts no liability for secondary damages or injuries resulting from continued use of a damaged or broken item.
- Statutory Rights: Nothing in these Terms shall limit or exclude our liability for death or personal injury resulting directly from our proven negligence, fraud, or any other liability that cannot be lawfully excluded under UK law (including your statutory rights under the UK Consumer Rights Act 2015).
4. Ordering, Pricing & Payments
- All prices shown are in GBP (£) and are inclusive of applicable UK VAT (unless stated otherwise).
- We reserve the right to refuse or cancel any order for reasons including, but not limited to: product availability, errors in product descriptions or pricing, or suspected fraud.
- Payment processing on our website and Shopify channel is handled securely via compliant third-party payment gateways.
5. Shipping, Returns & Cancellations
- Delivery: We only ship to valid addresses within the United Kingdom. Estimated delivery times are guidelines and not guaranteed.
- Cancellation Rights: Under UK Consumer Contracts Regulations, you have the right to cancel your order within 14 days of receiving your items for a refund, provided the products remain unused, in their original packaging, and in a resaleable condition.
- Faulty Goods: If a product arrives defective or damaged prior to use, please contact us within 30 days of receipt to arrange a replacement or refund under your statutory rights.
